Australia Plans Tighter Student Visa Settings: What Students With Spouses and Children Should Prepare For

News · 2026-09-16 · 4 min read

Australia looks set for a significant immigration overhaul. If you are an international student, or about to become one, and you expect your family to travel with you, the details below deserve your attention. We cover the announcement, the numbers, the politics and the practical steps.

Family accompaniment under review

This Thursday, Home Affairs Minister Tony Burke will reportedly announce broad reforms making it much tougher for overseas students to have husbands, wives, children or other relatives join them in Australia. Addressing the National Press Club, Burke will set out the government's intention to take several visa types off uncapped, demand-led arrangements and place them under tighter numbers set by government.

Consider the size of the change. Over 337,000 student visas were granted last year, and roughly 45,000 of those were for family members coming with the student. Under the new model, the expectation is that most students will study in Australia alone.

Where the intake numbers stand

MeasureFigure reported
Net Overseas Migration (NOM) nowapproximately 305,000
Government target, within two years225,000
Permanent migrants still allowed annuallyaround 185,000

NOM is already heading down. It has declined over seven quarters in a row since late 2023, and projections point to it possibly falling below its pre-pandemic level by 2027-28.

Political pressure behind the announcement

The rise of One Nation, fed largely by voter unease over migration, has pushed Labor to move on a package it had been holding for weeks. The Press Club appearance had originally been booked over a month ago, then cancelled at short notice after disagreement inside cabinet over how hard the reforms should bite.

Changes that reach past students' relatives

The reforms go beyond family visas. Other likely targets include:

  • Visa-hopping: shutting the loopholes people use, once a visa has run out, to move onto a different category and stay longer
  • Removals: streamlining the appeals system so that unsuccessful applicants leave faster
  • Unlawful non-citizens: with nearly 111,000 people at some point in the deportation or review pipeline as of July, expect closer scrutiny here as well

Can it happen without parliament?

Prime Minister Anthony Albanese sought a deal with Opposition Leader Angus Taylor last week to secure cross-party backing for new laws, but the talks collapsed. If legislation cannot pass, Labor may turn to regulatory powers and departmental directives, all the more so because Albanese leaves for the UN General Assembly in New York this Friday.

Criticism from all sides

  • Independent Senator David Pocock argues that Australia should stop debating headline numbers alone and instead develop a genuine 10-year migration strategy, weighing skills demand against pressure on housing and the environment.
  • Business groups, speaking through ACCI chief Andrew McKellar, contend that the true crisis lies in housing supply and skills shortages rather than migration, and that reducing intake fixes neither.
  • One Nation wants much larger cuts: 750,000+ fewer temporary migrants over three years. Universities, aged care providers and both major parties have criticised this as damaging to the economy.

Practical steps if your family is part of the plan

Students who were relying on bringing a partner or children may find the opportunity under today's rules closing quickly. Sensible moves include:

  1. Watch Thursday's announcement to learn which visa subclasses are affected and the start dates.
  2. Weigh your timing: applications lodged ahead of the new rules may be grandfathered under the existing settings.
  3. Compare alternatives: skilled migration and partner visa pathways may prove more stable than student dependent visas from here on.
  4. Get advice from a registered migration agent before locking in irreversible study decisions that rely on family coming with you.

Keeping your plans flexible

Students in Pakistan and elsewhere should treat this as a developing story and wait for Burke's full announcement and the legislative detail before committing. Keep your documents in order, including a police character certificate if one is requested, and confirm any emigration formalities with the Bureau of Emigration & Overseas Employment before you travel.
