For employers recruiting from abroad, and for nurses, teachers and tradespeople who plan to apply from outside the country, the new arrangement works against offshore applicants. The Directive in Brief

In July, Home Affairs Minister Tony Burke issued a directive that ends first-in-first-served processing. Skilled and employer-sponsored applications are now placed into five priority tiers.

  • Highest priority: defence and law enforcement workers.
  • Next in line: construction, healthcare and teaching professionals, but only those already living in Australia.
  • Effectively last: everyone applying from offshore who does not work in defence or policing.

Location Beats Occupation Under the New Order

The detail that concerns migration agents and employers most is that the tiers rank applicants by where they are, not by what they do. An offshore nurse can be overtaken by an onshore applicant in an unrelated occupation with lower demand, purely because of geography rather than job category. Industry figures have noted that a marketing manager already inside Australia could get through faster than a nurse waiting overseas. That raises a fair question: is the policy aimed at the skills shortage, or simply at reducing visa volume?

Business groups have been openly critical. Some call the change a "blunt tool"; others describe it as a retreat from the streamlined post-COVID processing system towards something resembling an emergency handbrake.

How the Change Fits Wider Migration Reform

The directive is one piece of a broader shift. It follows a similar July measure that stalled processing of Working Holiday Maker (backpacker) visas. It also comes ahead of a larger migration overhaul that Minister Burke has been preparing, which was first due to be unveiled at the National Press Club before that launch was postponed.

The target is a number. The aim is to bring Net Overseas Migration down from about 300,000 now to Labor's goal of 225,000 by 2028, far below the peak of 556,000 recorded after borders reopened.

Other ideas reportedly on the table:

  • Removing work rights from visa holders whose protection claims have been rejected, aimed at bridging visa holders who stay in the country long after their claims are decided.
  • Closer attention to the bridging visa group, which has more than tripled since 2017, from roughly 130,000 to more than 413,000 people.

There is still no political agreement on how migration should be cut. Some favour deeper reductions in international student numbers (now above 528,000 and sharply higher than in 2017). Others want backpacker visas protected because regional and agricultural areas rely on them. The opposition is itself publicly split on the right approach.

  • Employers sponsoring offshore staff: especially in healthcare or education, add the longer timeline to workforce plans now. Treat 12 months as a realistic minimum rather than a worst case.

  • Applicants considering lodging from offshore: get informed advice first, because broad policy changes like this can alter eligibility and strategy overnight.
